Terms of Use and Trading Risk Agreement

These Terms form a binding agreement between you and Michael Iriarte, the California-based operator of Trade Ops (“Trade Ops,” “we,” “us,” or “our”). By accepting these Terms or using the member dashboard, you agree to every section below. If you do not agree, do not use the dashboard.
1. Eligibility and account responsibility
You must be at least 18 and legally able to enter this agreement. You are responsible for your account, your device, and activity under your account. Do not share access or attempt to bypass access controls.
2. Research software—not personalized advice
Trade Ops provides impersonal market research, screening, ranking, modeling, and organizational tools. It does not know your complete financial circumstances, objectives, tax situation, experience, portfolio, liquidity needs, or risk tolerance. A watchlist or preference filters information you choose to view; it does not make the information suitable for you.
Michael Iriarte and Trade Ops are not registered investment advisers, broker-dealers, brokers, commodity trading advisers, financial planners, or fiduciaries. The service is not offered as personalized investment, legal, tax, or accounting advice; a recommendation or solicitation to buy, sell, hold, or enter any security or strategy; portfolio management; trade execution; or ongoing monitoring of your positions.
3. You make every decision
You are solely responsible for independently evaluating and verifying every security, strategy, price, contract, expiration, event, and risk before acting. Consult appropriately licensed financial, legal, and tax professionals. Trade Ops does not approve, supervise, or know whether any trade is appropriate for you. No dashboard output should be the sole basis for risking money.
4. Trading risk
All investing and trading involves risk. Stocks, exchange-traded products, and options can be volatile and can lose substantial value. You may lose your entire investment. Options can expire worthless; short options can create assignment, early-exercise, liquidity, leverage, and potentially very large or unlimited loss risk; multi-leg strategies may not execute together and may have margin consequences. Market gaps can prevent exits at expected prices. Past performance does not predict future results.
5. Data, scores, models, and backtests
Information is presented for informational research purposes in the form received from third-party sources or as derived, summarized, calculated, or modeled by Trade Ops. Michael Iriarte and Trade Ops do not independently guarantee or represent that any data or output is accurate, complete, current, or suitable for trading. Information may be delayed, stale, incomplete, adjusted, estimated, modeled, unavailable, or incorrect.
Scores and rankings are mechanical research outputs—not probabilities of profit or expected return. Projections, scenarios, historical studies, and backtests rely on assumptions, may use overlapping or limited observations, may omit fees, taxes, slippage, liquidity, assignment, or execution constraints, and do not represent actual trading. Results can change without notice. Always verify current information with primary sources and your broker.
6. No execution, custody, or monitoring
Trade Ops does not connect to a brokerage account, hold funds or securities, route or execute orders, guarantee alerts, or monitor positions for you. You are responsible for order details, position sizing, diversification, margin, exits, exercise instructions, tax consequences, and compliance with broker and legal requirements.
7. No guarantees and no reliance on availability
We do not guarantee accuracy, completeness, timeliness, profitability, availability, notification delivery, or any particular result. The service may be changed, interrupted, restricted, or discontinued. Do not rely on Trade Ops for time-sensitive decisions, emergency action, or loss prevention.
8. Subscriptions and billing
Prices, trial terms, renewal timing, and cancellation options are shown before checkout. Payments are processed by Stripe. Unless canceled before renewal, a subscription may renew at the disclosed interval and price. You may manage or cancel through the billing portal. Except where law requires otherwise, charges already incurred are nonrefundable.
9. Acceptable use
You may use Trade Ops only for lawful personal or internal research. You may not misuse the service, interfere with its operation, evade security or access limits, scrape or redistribute substantial portions, reverse engineer protected components, impersonate another person, or use outputs to make misleading claims to others.
10. Intellectual property and third parties
Trade Ops software, presentation, scoring systems, and original content are owned by Michael Iriarte or licensed providers. Market data, company names, and third-party services remain subject to their owners’ rights and terms. Links and integrations do not imply endorsement, and third-party services are governed by their own terms and privacy practices.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADE OPS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow certain exclusions, so some may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICHAEL IRIARTE AND TRADE OPS WILL NOT BE LIABLE FOR TRADING OR INVESTMENT LOSSES, LOST PROFITS, LOST OPPORTUNITIES, DATA LOSS, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO TRADE OPS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not exclude liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other non-waivable rights.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Michael Iriarte and Trade Ops from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the service, violation of these Terms, or infringement of another person’s rights. This does not require you to indemnify us for our own fraud, willful misconduct, or obligations that cannot legally be shifted to you.
14. Suspension and termination
We may suspend or terminate access for violation of these Terms, security risk, nonpayment, legal requirements, or discontinuation of the service. You may stop using Trade Ops and cancel a subscription at any time. Provisions that by their nature should survive termination—including risk allocation, intellectual property, disclaimers, liability limits, and disputes—will survive.
15. Changes
We may revise these Terms. Material revisions will be posted with a new effective date, and signed-in users may be required to accept the new version before accessing the dashboard.
16. California law and disputes
These Terms are governed by California law, without regard to conflict-of-law principles. Before filing a claim, you and Trade Ops agree to make a good-faith effort to resolve it through written notice and 30 days of informal discussion. If unresolved, claims may be brought in a state or federal court in California that has lawful jurisdiction and venue, subject to any non-waivable consumer rights. Nothing here prevents either party from seeking appropriate relief in small-claims court or from a government agency.
17. General terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer this agreement without consent; we may transfer it as part of a business reorganization or sale. These Terms, together with the Privacy Policy and checkout disclosures, are the entire agreement about the service.
